Description:
A Student Intern assigned to the Office of General Counsel would be responsible for, but is not limited to, the following activities:
* Perform routine legal research, analyze data obtained using available reference sources such as Law Desk, Lexis Nexis, the Law Library, etc., and prepare a digest of the points of law involved.
* Research case law and draft preliminary memoranda of law and legal opinions.
* Review claims in which an application for Administrative Review has been filed from a law judge decision or a Full Board Review (FBR) has been filed from a Board Panel decision. Draft a detailed and legally accurate memoranda of law articulating the issues raised on appeal. Draft a decision for review by an Associate Attorney for submission to a Board Panel. For FBR applications, make recommendations on modification or rescission of the subject decision or recommend denial of FBR and submit to the appropriate person for review.
* Assist in the processing of Freedom of Information Law (FOIL) requests and appeals.
* Set up and maintain legal files for provider disciplines, both hard copy and electronically on office "M drive." File letters and documents correctly in accordance with office filing system.
* Gather and create materials and legal summaries in preparation of suspension, revocation, reinstatement, and reconsideration documents, including letters, notices, interrogatories, affidavits, motions, Subject Numbers, and intra-agency correspondence.
* Track and manage cases through completion. Prepare final documents for closing files.
* Participate in "special projects" as requested by the General Counsel, Deputy Counsel, Supervising Attorney in the Office of General Counsel, or the Executive Director in the Office of the Chair, concerning the application of Workers' Compensation Law pertinent to this agency.
* Prepare routine legal correspondence as requested.
The Student Assistant is expected to work directly with the individual who assigned the work. The scope and depth of their work is clearly defined by the supervising attorney.
